We reserve the right to make changes to our Terms and Conditions, please read these conditions carefully before using the mamaBAshop.com website. Before using the mamaBAshop website you signify your agreement to be bound by these conditions. Due to possible changes within our Terms and Conditions, We suggest that you check here often for any updates and amendments. We are not responsible for manufacturer price changes, typographical errors, pictorial errors or technical inaccuracies. Price and availability of products on the Site are subject to change without notice. mamaBAshop.com reserves the right to revoke, refuse or cancel any orders placed for products which may have been listed at the incorrect price including after an order has been submitted. In the event that payment has been made for a purchase following a cancelled order, mamaBAshop.com shall issue a full refund to your money.
Pricing Prices at mamaBAshop.com are subject to changes without notice, we reserve the right to change our prices at any time. The prices shown exclude shipping and sales taxes where applicable unless otherwise expressed in the product description. All prices are listed in Euros. We strive to provide accurate pricing however, In the event of any incorrect pricing posted online due to typographical or human error, mamaBAshop.com reserves the right to refuse and cancel orders placed for incorrectly priced items.
Product availability and shipping All products sold by mamaBAshop.com are available for shipping unless otherwise stated. Due to the fact that most products on sale at mamaBAshop.com are either Europe or North American based, all shipping times shown for each product are "approximate". Neither mamaBAshop.com or the Sweet Mother Services offer any indication toward delivery times. Products purchased may in some cases be shipped earlier than originally stated. All purchased products shall be collected by the buyer at one of our offices and warehouses located throughout Ghana. The collection point shall be made known to the buyer
Return Policy mamaBAshop.com offers a 3 day return policy for Customers unless otherwise stated however, all products sold at mamaBAshop.com are covered by a Manufacturer’s warranty which may differ depending on individual countries. Original shipping and handling (if applicable) charges are not-refundable. The Customer is responsible for the return shipping and handling costs for all returned products, (should this be applicable). All returns must obtain a RPA number (Return Product Authorization) from mamaBAshop.com "prior to returning an item". Any returns we receive without an RPA number will not be accepted and will be returned back to the customer and any credit due for the return of item’s without an RPA will not be reimbursed. RPA numbers are valid for 14 days from the date of issue. Returns must be 100% complete, in original factory condition, including the original boxes, packing materials, contents, manuals, inserts, warranty card(s), etc. Additional charges may apply should the merchandise not be returned in its original condition. To obtain an RPA number, please call our Customer Service. All returned items must be shipped to our European or American address, the address details will be provided together with the RPA number. When returning a product, we recommend that adequate insurance is arranged for the returned item. mamaBAshop will not accept responsibility in the event an item becomes lost or damaged while in transit. It is the responsibility of the sender to make sure returned items (are adequately insured by the carrier). The RPA number must appear clearly on the shipping label affixed on the outside of all returned items. We reserve the right to refuse the return of any product that does not meet the requirements detailed in the mamaBAshop Customer Account section. In the event your product is delivered in damaged condition resulting from transit, please do not accept delivery and request that the delivering agent return the item back to the sender. In such circumstances you may need to complete a returns form provided by the courier company. Upon receipt of any damaged or refused merchandise to our warehouse, following verification by mamaBAshop we will despatch a replacement item to you.
Indemnity You agree and accept to indemnify and hold mamaBAshop.com, Sweet Mother Services, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the service in violation of this Agreement and/or arising from a breach of these Terms and Conditions of Use and/or any breach of your representations and warranties set forth above.
Arbitration of Disputes Any and all disputes arising out of or related to these Terms and Conditions of Use and/or your relationship with mamaBAshop.com and/or your use of this Site shall be submitted to binding arbitration according to the rules of the Ghana Arbitration Association. The parties to the arbitration shall evenly divide any and all costs of the arbitration. Neither party shall be entitled to attorney fees. All parties submit to exclusive jurisdiction in Kumasi (Ghana). The arbitration shall take place exclusively in Kumasi before a retired judge and shall be governed by Ghana law without regard to its conflict of law provisions.
